ARTICLE 1 – PURPOSE:
The present General Terms (hereafter "GT") determine the conditions under which the company DAILY ART FAIR (hereafter " DAILY ART FAIR") makes the website www.DailyArtFair.com (hereafter the "Website") available to any web user who connects to it (hereafter the "User") and the conditions according to which the User has access to and uses the Website.
The purpose of the present Website is to promote and broadcast information concerning art, in particular by the presentation of a selection of significant events and exhibitions within several art galleries.
The User is deemed to have accepted the entire present GT, as soon as it has access to them on the Website and maintains its connexion to the Website.
DAILY ART FAIR reserves the right to modify or update the present GT, at any moment and without notice. In this respect, the User is required to consult the GT regularly.
ARTICLE 2 – ACCESS TO THE WEBSITE, TO THE SERVICES AND LIMITATION OF LIABILITY:
DAILY ART FAIR makes its best efforts to maintain access to the Website. However, given the specificities of the Internet network, the access to the Website may be temporarily or permanently interrupted, for, among others and not limited to, legal, technical or maintenance reasons. No compensation whatsoever can be awarded by DAILY ART FAIR in relation to the unavailability of the Website, should it be temporary or permanent, whatever the direct or indirect damage or loss suffered may be.
The User shall not access the Website by a fraudulent way.
DAILY ART FAIR makes its best efforts to offer an optimised guarantee of security of the transferred data. ARTICLE 3 – INTELLECTUAL PROPERTY:
The content, including but not limited to the texts and graphic elements, their assembling on the Website, in particular the arborescence, the logos, distinctive signs, the present GT and the Website are the exclusive property of DAILY ART FAIR or third parties and are protected by the applicable intellectual property law and competition law.
In particular, the present Website and its content are considered as a database as defined by article L.112-3 of the French intellectual property code and therefore benefit from copyright protection for the operator.
As a consequence, any copy, picture, replication, exploitation, alteration, modification, entire or partial diffusion, commercial use of content, of the present GT or Website is illicit and exposes its author to civil and/or criminal proceedings which may be brought against them before French Courts, unless DAILY ART FAIR's prior and express approval is obtained.
ARTICLE 4 – USE OF CONTENT BY THE USER:
The purpose of the present Website is to promote and broadcast information concerning art, in particular by the referencing and presentation of a selection of significant events and exhibitions within several art galleries. The User commits to use the present Website in accordance with its purpose.
The alteration or modification of the content or its use for another goal than the authorised goal is a breach of the rights of DAILY ART FAIR or third parties. DAILY ART FAIR may not be held liable for any use that may be fraudulent or contrary to the present GT and that may infringe the rights of a third party.
The User is not authorised to collect the personal data of other users to which it may have access and to use this data for illicit and/or commercial means.
ARTICLE 5 – GUARANTEE AND LIABILITY:
DAILY ART FAIR benefits from the legal status of web hosting provider as defined by article 6-I-2 of Statute n°2004-575, Loi de Confiance dans l'Economie Numérique (LCEN) dated 21 June 2004, in respect of the data published on the Website. DAILY ART FAIR therefore benefits from the reduced liability system in the event of illicit content, as considered such by the applicable statutes and case law, such as but not limited to, denying crimes against humanity or incitement to racial hatred.
In this respect, DAILY ART FAIR cannot be held civilly liable in relation to activities or information stored upon the request of a recipient of the services, if DAILY ART FAIR did not have knowledge of their illicit nature or of facts and circumstances implying this illicit nature, or if, upon knowledge of this, it acted promptly to remove the data or make access impossible.
Moreover, and as per article 6-I-3 of Statute n°2004-575, Loi de Confiance dans l'Economie Numérique (LCEN) dated 21 June 2004, DAILY ART FAIR cannot be held liable on a criminal basis, in relation to activities or information stored upon the request of a recipient of the services, if DAILY ART FAIR did not have knowledge of the illicit activity or information, or if, upon knowledge of this, it acted promptly to remove the data or make access impossible.
In accordance with article 6-I-5 of Statute n°2004-575, Loi de Confiance dans l'Economie Numérique (LCEN) dated 21 June 2004, knowledge of the contentious facts is presumed when the User notifies to DAILY ART FAIR the following elements, under these strict conditions:
« - Date of the notification;
- If the notifier is an individual: its name, surname, profession, address, nationality, date and place of birth; if the notifier is an entity: its form, its name, its head office, and its legal representative;
- The name and address of the recipient, or, if it is an entity, its name and head offic ;
- The description of the contentious facts and their exact location;

In order to continuously improve the quality of the Website, DAILY ART FAIR collects anonymous data in respect of the browsing of the User on the Website (such as visited pages, date and times of visit).

French law governs the present GT.
ANY DISPUTE IN RELATION TO THE WEBSITE OR THE PRESENT GT CONCERNING BUT NOT LIMITED TO THEIR VALIDITY, INTERPRETATION, PERFORMANCE OR NON PERFORMANCE, SHALL BE BROUGHT, EVEN FOR INTERIM MEASURES (REFERE), BEFORE THE COURTS WITHIN THE JURISDICTION OF THE PARIS COURT OF APPEAL.
The use of the Website is considered as the express approval of the User for the present clause to be applied.
In the event one of the provisions of the present GT were declared illegal, null and void or deemed unwritten, for any reason whatsoever, all of the other provisions would remain applicable.
